CMS Publishes Federal Register Notice Regarding Termination of Several ERRP Processes
The Federal Register Notice (CMS- 9996-N4) sets forth termination dates for several processes under the Early Retiree Reinsurance Program (ERRP). In preparation for the January 1, 2014 program sunset date, CMS is planning for the phase-down of the ERRP Secure Website so that it eventually can be taken offline and archived. The termination dates included in the notice will allow for a phase-down of ERRP operational processes related to the ERRP Secure Website. Specifically, the notice indicates that the last day upon which plan sponsors:
Will be required to update information contained in either their paper application or the ERRP Secure Website is December 31, 2013.
Will be able to submit an ERRP reimbursement request is July 31, 2013.
Will be required to submit corrections to data inaccuracies is July 31, 2013, i.e., the last day upon which a plan sponsor may submit an ERRP reimbursement request.
Will be able to submit an ERRP reopening request is December 31, 2013.
Additionally, the notice indicates that plan sponsors do not need to notify CMS of a change of ownership in instances where the anticipated effective date of the change would occur after December 31, 2013.
Although, this notice sets forth the termination dates for processes that involve plan sponsors' reporting and submitting of information, it does not limit the requirements in the ERRP regulations at 45 CFR 149.350, which require plan sponsors to maintain and furnish to the HHS Secretary upon request, certain records enumerated in those regulations.
CMS will continue to recover identified overpayments and distribute them to plan sponsors, based on the order in which the reimbursement requests were received, pending available funding.
